Notice of Claimed Infringement

Important Note on Advertiser and Publisher Responsibility
Traffic Stars serves as a facilitator, connecting advertisers with publishers but does not host or control ad content on publisher websites. Advertisers are solely responsible for ensuring that their content complies with copyright and intellectual property laws, warranting that they hold all necessary rights for the materials they submit for display. Traffic Stars reserves the right to disable access to infringing content on our platform in cases of verified copyright violations, particularly in cases of repeat infringement, while requiring copyright claims to be handled directly with advertisers when possible. Publishers, as the hosting party, are responsible for any content displayed on their sites and must respond to valid DMCA takedown notices if the content is hosted on their website.
For content displayed directly on our platform, Traffic Stars will respond to valid DMCA takedown notices and remove or disable access to any infringing material. However, we are unable to act on or control content hosted on publisher sites, and we recommend directing takedown requests for hosted content to the publisher directly.
Take Down Procedure
Our Website implements the following procedure upon receipt of any valid DMCA notice for content accessible on our platform:

Upon receiving a valid notice, we may disable access to or remove any infringing content displayed directly on our platform.

We will notify the affected advertiser and provide them with the opportunity to submit a counter-notification if they believe the material was mistakenly removed.
For any content hosted on a publisher’s site, please contact the publisher directly, as we are unable to act on content outside our platform.
DMCA Counter-Notification Procedure
If you believe that a DMCA takedown request was submitted in error for content on our Website, and/or that allegedly infringing material has been wrongly removed in accordance with the procedures outlined above, you may submit a counter-notification pursuant to Section 512(g)(2)&(3) of the DMCA. This procedure is intended solely for disputing removals of content displayed on our platform, not for content hosted on publisher websites.
To submit a counter-notification, please provide Our Designated Copyright Agent the following information:
- A specific description of the material that was removed or disabled pursuant to the Notice.
- A description of where the material was located within the Website or the content before such material was removed and/or disabled (preferably including specific URL’s associated with the material).
- A statement reflecting your belief that the removal or disabling of the material was done so erroneously. For convenience, the following format may be used: “I swear, under penalty of perjury, that I have a good faith belief that the referenced material was removed or disabled by the service provider as a result of mistake or misidentification of the material to be removed or disabled.”
- Your physical address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court in and for the judicial district where you are located, or if you are outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the Notice, or that person’s agent.
Abuse Notification
Abusing the DMCA procedures or misrepresenting facts in a DMCA Notice or Counter-notification can result in legal liability for damages, court costs, and attorney’s fees. This Notice and Takedown Procedure only applies to claims of copyright infringement by copyright holders and their appointed agents.
Service Provider Customers or Users
If the alleged infringer identified in a DMCA Notice is also a “Service Provider” within the meaning of 17 U.S.C. §512(k)(1), please direct DMCA Notices to the designated agent for that service provider, rather than to us.
Modifications to this Policy
Our Website reserves the right to modify, alter or add to this policy, and all affected persons should check regularly to stay informed of any changes.
